Social Security Disability Defined
The Social Security Administration administers two separate and distinct federal income support programs for people who are disabled:
Social Security Disability Eligibility
Although there are differences between the two programs in terms of both the purposes and eligibility requirements, both disability you must be able to prove that you have a medically determinable medical impairment that has caused the inability to do any substantial gainful activity for a period that has lasted, or is expected to last, at least 12 months.
FICA
The Social Security Disability Insurance (SSDI) program is paid for by the contributions of workers, employers and the self-employed through the Federal Insurance Contributions Act (FICA). The SSI program, on the other hand, is funded by taxes from the general federal taxes. You need not have contributed through FICA in order to be eligible for the SSI program.
Social Security Disability Laws
The Social Security Disability programs provide income support for the disabled and are administered by the Social Security Administration (SSA). As such, all aspects of the program are regulated by statute, including eligibility requirements, the type of program for which you qualify, as well as the type of insurance you are entitled to, depending on the whether you meet the requirements for SSDI or SSI.
While for some law firms SSDI and SSI are marginal parts of their practice, at the law firm of Jeffrey A. Rabin & Associates, it is our practice and we specialize in securing assistance for our clients who are in need of SSDI or SSI benefits.
