JEFFREY RABIN: One of the most common questions clients ask me is how do I survive during the time that my case is pending? The law does allow people to work to a certain extent while their claim is being processed. The Social Security Act has a definition for what's called substantial gainful activity. In 2009, that's any full or part time work which generates at least $980 gross income in a month.
The problem comes in from the Social Security Administration being so backlogged. There are hundreds of thousands of cases pending at each level of the Social Security Administration review process and it can take many, many months for client's cases to move through the system.
