Chicago Lawyers Experienced At Handling SSDI And SSI Claims Related To Cancer

The Social Security Administration (SSA) recognizes cancer as causing impairments that qualify for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI). However, the SSA examines each case individually to determine whether the effects of the cancer or the cancer treatment will last or can be expected to last “not less than 12 months or result in death.”

Cancer Treatment And SSDI And SSI Claims

The Social Security Administration assumes that the effects of cancer treatment will only last for a limited duration, and not meet the one-year requirement. However, each individual reacts to surgery, irradiation, chemotherapy, hormones, immunotherapy, and bone marrow or stem cell transplantation differently. Additionally, if after treatment malignancy persists, progresses or recurs, the SSA will approve SSDI or SSI insurance benefits.

The Social Security Administration classifies cancer as a malignant neoplastic disease. Simply stated, it is abnormal cancerous growths, such as tumors. In determining long-term disability insurance benefits for cancer the SSA considers four factors:

    • Origin of the malignancy
    • Extent of involvement
    • Duration, frequency and response to antineoplastic therapy. Antineoplastic therapy means surgery, irradiation, chemotherapy, hormones, immunotherapy, and bone marrow or stem cell transplantation
    • Effects of any post-therapeutic residuals

Our lawyers concentrate on handling Social Security Disability Insurance and Supplemental Security Income claims. We understand what documentation is necessary to prove disabilities under the Social Security Administration’s guidelines.

Applying For SSDI Or SSI Benefits In Relation To Cancer

The Social Security Disability application process is intended to allow claimants to handle claims without legal counsel, especially as they relate to listed impairments such as lymphoma, leukemia, breast cancer, skin cancer, brain cancer and thyroid cancer. However, only 35 percent of all Social Security Disability applications are approved at their initial filing. As experienced Social Security Disability lawyers, we understand the application process, what medical information needs to be presented to get Social Security Disability benefits, and how to appropriately fill out application forms for cancer-related SSDI or SSI applications. In addition, we have extensive experience handling Requests for Reconsideration and hearings before administrative law judges (ALJs) when SSDI and SSI benefits are denied.

    Why Our Clients Trust Us

My experience with Jeffrey A Rabin has been very good.

My approval of Social Security disability benefits came much quicker than I had expected. I first met with an associate on April 16, 2020 and we filed my application on May 21, 2020. My application was approved on August 3, 2020, only around a four month process. Even though we were at the beginning of this coronavirus outbreak when we started, it was easy to contact them and complete this process.

This was an outstanding experience for me from my first appointment to the last.

This Law Firm was very professional kind and considerate of me and my disability. They knew exactly what it was like for me in the real world and absolutely essential to help me explain that and my disability to the Social Security Administration. I definitely could not have done this without them and they have changed my life for the better forever. In my eyes they are the best social security disability law firm in Chicago and the suburbs.

I wanted to say thank you for everything that you did for me, I greatly appreciate it.

You believed in me when a lot and social security did not. I was a risk for you to pay for my medical records, not knowing if you would win, if I had not won you would have been out of a lot of money and time. I have known other attorney’s, and have worked with them in the past, but they are nothing like you! You are a very kind generous human being with compassion. I pray that God will bless you practice and make you very successful ...
